Rogers IP Group's patent services include the fililng of U.S. and foreign patent applications, provisional patent applications, patent searches, and a variety of patentability opinions.  While our specialization is the protection of biotechnology and related inventions, both product and process, we also file patents for mechanical inventions.

Below are estimates of typical charges for various patent related matters, ranging from simple matters to more complex inventions and processes. Please note that fees are estimated, and can vary considerably depending on the complexity of the matter.


Fees for Filing a U.S. Patent Application

Formal U.S. patents come in three varieties: (1) utility patents for the protection of the function of a device, invention, or method; (2) design patents, for the protection of the aesthetic appearance of an industrial device; and (3) plant patents for the protection and commercialization of asexually reproduced plants. 

The range of our legal fees takes into account the complexity of the item being patented, with lower rates for relatively simple inventions and higher rates for more complex inventions, compositions, or processes.

    Utility Patent :  $ 2,500  -  $ 6,000
 Design Patent:   $ 1,000  -  $ 2,000          

NOTE:  a retainer which is a fee payable in advance of $1,000 is required before work commences on the filing of a patent application. This fee is applied to costs and service fees listed here. This fee is also applied to our background search on your invention which we do for all inventors prior to drafting a patent application.


Office Action Responses

After filing of a patent application, the Patent & Trademark Office (PTO) examiner puts forth objections to the patentability of the invention in one or more Office Actions. Typically responses to two office actions are required, though the number and complexity of these responses can vary. These responses are generally prepared 2.5 years after preparation and filing of your regular utility patent application.

Office Action Response:  $ 800 -- $ 2,500  


Other Patent Procurement Actions

In addition to responding to Office Actions, patent procurement can involve other necessary actions on the part of an inventor. The necessity of these actions will depend on your technology. For example, DNA sequence listings are usually required for certain biotechnology inventions. All technologies, however, require such actions as filing Information Disclosure Statements which are disclosures to the PTO concerning publications which are material to the patenting of your invention. Upon allowance of the patent, all patent applications should be reviewed for correctness and completeness. An issuance fee also needs to be paid in order for you to obtain your patent.

  Review of Patent Application & Issue Fee Payment : $ 300 - $ 600


Government Patent Fees

In addition to the legal fees above, various fees need to be paid to the PTO upon filing the patent application. Other fees are necessary as the patent process moves along. The prices differ depending on whether you are a small entity (i.e., under 500 employees) or a large entity (i.e., over 500 employees). In general, large entities pay twice as much for all government fees. Below are some sample government fees that a small entity can expect to pay during the patent process of a utility patent. Please note that these sample government fees change regularly at the PTO and the fees listed below do not take into account certain contingencies such as excess claim fees. For example, regular utitliy patent application which are filed with more then 3 independent claims or claims in excess of 20 will incur additional surcharges by the PTO.
